These Terms and Conditions explain how Newtons Heating and Air Conditioning provides services and how customers are expected to engage with them. By scheduling a service or using the website, you agree to these terms. Everything is written to be clear and practical.
Scope of Work and Service Access
Each service is performed based on a defined scope. For example, a standard AC tune-up includes inspection, cleaning, and system performance checks. It does not include services like duct cleaning, structural work, or electrical panel upgrades unless clearly stated.
Customers must provide safe and clear access to the system. This includes attics, crawl spaces, closets, or outdoor units. If the technician cannot safely reach the unit due to blocked areas, locked spaces, or unsafe conditions, the visit may still result in a service or trip fee.
The area around the unit should be cleared before the appointment. This helps the technician complete the work without delay.
Payment and Financial Responsibility
Payment is due upon completion of the service unless agreed otherwise in writing. This applies to both labor and any installed equipment.
Unpaid balances may be subject to a monthly interest charge, typically between 1.5 percent and 2 percent. Continued non-payment may lead to further action as allowed by law.
Where applicable, the company reserves the right to file a mechanic’s lien against the property for unpaid services, materials, or equipment, as permitted by local regulations.
Warranties and Service Guarantees
Parts used during repairs or installations may be covered by manufacturer warranties. These warranties are provided by the equipment manufacturer and follow their terms.
Labor and workmanship are usually covered under a limited guarantee, often up to one year for new installations. Coverage may vary depending on the service.
Warranty coverage may be void if the system is altered or repaired by an unlicensed third party, or if basic maintenance, such as regular filter changes, is not maintained.
Limitations of Liability
The company is not responsible for indirect or consequential damages. This includes situations where system issues lead to damage beyond the HVAC unit itself, unless negligence is clearly proven.
Pre-existing conditions are not covered. This includes aging ductwork, structural limitations, or earlier system issues that become noticeable during or after service.
Maintenance Plans and Service Agreements
Maintenance plans are designed for ongoing system care and priority scheduling. These plans usually renew automatically unless canceled in advance, typically with a 30-day notice.
Members may receive priority service during high-demand periods. Availability still depends on scheduling conditions.
Maintenance agreements are generally tied to the serviced property. They may not transfer to a new property if the customer moves.
General Use of Website
The website provides general information about services. While efforts are made to keep content accurate, completeness and timeliness cannot always be guaranteed.
Users agree to use the website responsibly and not submit false or misleading information or attempt to interfere with its functionality.
